Terms of Service

1. Agreement to Terms

By accessing or using SCOUTb2 ("Service"), operated by bee2.io LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

Age eligibility: You must be at least 16 years old (or the age of majority in your jurisdiction, whichever is higher) to use the Service. If you are under 18, you represent that you have your parent or guardian's consent to use the Service. We do not knowingly collect personal information from children under 13 (see our Privacy Policy).

2. Description of Service

SCOUTb2 is a browser extension and web service that performs automated checks on websites in the following areas:

• Accessibility (select WCAG 2.2 criteria -- not exhaustive)
• Performance metrics (Core Web Vitals)
• SEO indicators
• Security headers and mixed content
• Internationalization (i18n)

SCOUTb2 is an automated tool that checks for a subset of potential issues. It does not perform a complete audit and cannot detect every issue. Results are informational only and do not constitute a certification of compliance with any standard or regulation. See Section 8 for full disclaimers.

The Service is provided in two tiers: FREE (single-page scanning) and PRO (multi-page scanning with AI insights, $4.99/month).

Service Worker Usage

Multi-page scans (PRO tier) use your browser's background service worker. Your computer must remain on during scans. Results are stored locally on your computer in chrome.storage.local (max 10 MB). For PRO features such as scheduled scans, scan summaries may be temporarily stored on our servers and automatically deleted after 90 days.

Scheduled Scans (PRO)

Scheduled scans use the extension's Chrome Alarms to trigger audits at your configured time.

• Chrome must be installed; if Chrome wasn't running, missed scans fire automatically on next launch.
• Scan results are stored locally in the extension. Email notifications include only the scanned URL hostname, overall score, and issue counts.
• Maximum 10 scheduled scans per PRO account.

Authenticated Pages

You are responsible for maintaining active authentication sessions when scanning login-protected pages. SCOUTb2 will pause and notify you if your session expires mid-scan.

Scan History

Scan history (saved reports) is a PRO-only feature. FREE tier users can view scan results during the current session but reports are not persisted to local storage. FREE users may export the current scan as HTML to save a copy.

Free Tools

We provide free web-based tools (e.g., contrast checker, meta tag analyzer, heading checker) on our website at scoutb2.io/tools/. These tools process all data entirely in your browser using client-side JavaScript. No content you paste or enter into any free tool is transmitted to our servers or any third party. No account is required to use the free tools.

3. Account Registration

FREE tier does not require an account to scan. You can install and use the extension for single-page scans without signing up. A free account (sign-in) is required to view full reports and export HTML.

To access PRO features, you must create an account by providing:

• A valid email address
• Authentication via magic link (OTP) or OAuth (Google, GitHub)

You are responsible for:

• Maintaining the confidentiality of your account
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

4. Acceptable Use

You agree NOT to:

• Scan websites you don't have permission to audit
• Use the Service to violate any laws or regulations
• Attempt to reverse engineer, decompile, or hack the extension
• Circumvent usage limits or payment requirements
• Share your PRO account credentials with others
• Use the Service to scrape or collect data for commercial purposes
• Overload our servers with excessive requests
• Upload malicious code or content

5. Subscription and Billing

Payment Processor & Merchant of Record

All payments for SCOUTb2 PRO subscriptions are processed by Paddle.com Market Limited ("Paddle"), which acts as the Merchant of Record for all transactions. Paddle handles billing, payment processing, sales tax, and invoicing on our behalf. When you subscribe to PRO, your contractual relationship for payment is with Paddle, governed by Paddle's Terms of Service. Your receipt and invoice will come from Paddle, not bee2.io LLC.

FREE Tier

The FREE tier is provided at no cost and includes single-page scanning. We reserve the right to modify or discontinue the FREE tier at any time.

PRO Tier ($4.99/month)

• Monthly billing only. No annual plans.
• Billed monthly via Paddle (Merchant of Record)
• Automatically renews unless canceled before the next billing date
• Includes multi-page scanning (up to 10,000 pages), AI insights (100 credits/month), mobile orientation testing, scheduled scans, and browser/email notifications
• Prices subject to change with 30 days notice

Refunds

If you are unsatisfied with SCOUTb2 PRO, you may request a full refund within 14 days of your initial subscription purchase. To request a refund, go to your Account dashboard and cancel your subscription. Refunds are processed by Paddle and typically appear within 5-10 business days. After the 14-day window, no refunds are issued for partial billing periods.

Cancellation

You may cancel your PRO subscription at any time from your account settings. Your PRO access continues until the end of your current billing period.

• Within 14 days of initial purchase: You receive a full refund and your account is immediately downgraded to Free.
• After the 14-day refund window: No refund is issued. Your PRO access continues until the end of your current billing period, then your account reverts to Free.

Billing Disputes

Because Paddle is the Merchant of Record, billing disputes (including chargebacks, refund requests, and invoice questions) should be directed to Paddle. You can contact Paddle's support through the link in your purchase receipt or invoice email. You can also manage your subscription and request refunds directly from your Account dashboard.

Service Discontinuation

If we discontinue the Service, we will provide 30 days notice via email. Active PRO subscriptions will receive prorated refunds for unused time, processed through Paddle.

6. Notifications

Browser Notifications

Multi-page scans (PRO tier) may send browser notifications when scans complete. These notifications are local to your computer and do not transmit any data to our servers. You can disable browser notifications in your browser settings.

Email Notifications (PRO)

PRO users may enable email notifications to receive scan completion summaries. When enabled, we send your overall score, issue counts, and scan duration to your registered email address via our email delivery provider. Email notifications are not available on the FREE tier. You can disable email notifications at any time in the extension settings.

7. Intellectual Property

The Service, including the extension code, website, logo, and documentation, is owned by bee2.io LLC and protected by copyright, trademark, and other intellectual property laws.

You retain ownership of:

• Websites you scan
• Scan results and reports you generate

We retain the right to use anonymized, aggregated data for improving the Service.

8. Disclaimers and Limitations

8.1 "AS IS" and "AS AVAILABLE" Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, bee2.io LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, RELIABILITY, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant or guarantee that:

• Scan results are accurate, complete, or free from errors
• The Service will detect all accessibility, performance, SEO, security, or other issues on any website
• The Service will be uninterrupted, timely, secure, or error-free
• Your website will meet any accessibility standard, legal requirement, or regulatory obligation as a result of using the Service
• AI-generated insights, recommendations, or fix suggestions are correct or suitable for your specific situation
• Defects in the Service will be corrected

All users (FREE and PRO) receive the same level of support via email.

8.2 No Guarantee of Compliance

SCOUTb2 does NOT guarantee WCAG conformity, ADA compliance, Section 508 compliance, EN 301 549 compliance, or conformity with any other accessibility standard, law, regulation, or guideline. Automated testing tools, including SCOUTb2, are inherently limited and cannot detect all accessibility barriers. Many accessibility requirements require human judgment, manual testing, and assistive technology evaluation that are beyond the scope of any automated tool.

A passing score or absence of reported issues does not mean your website is compliant with any standard or regulation. You are solely responsible for ensuring your own website meets applicable legal and regulatory requirements.

8.3 No Legal Liability for Missed Issues

SCOUTb2 shall not be held liable or accountable for any missed issues, false positives, false negatives, inaccurate assessments, incorrect severity ratings, or incomplete results. Automated scanning has known limitations and will not identify every issue present on a website. You acknowledge and accept that you bear full and sole responsibility for your website's accessibility, compliance, performance, security, and overall quality, regardless of what SCOUTb2 reports or fails to report.

8.4 Informational Purposes Only -- No Legal Binding

All audit results, scores, reports, AI insights, fix recommendations, and any other output produced by SCOUTb2 are for informational and reference purposes only. They do not constitute and shall not be construed as:

• A legal audit or legal assessment of any kind
• A certification, attestation, or guarantee of compliance with any standard, regulation, or law
• Legal advice or a legal opinion
• A legally binding determination of a website's accessibility, quality, or regulatory status
• Evidence of due diligence or good faith compliance efforts (though users may choose to incorporate results into their own compliance processes at their own discretion)

SCOUTb2 output has no legal binding force or effect. No third party may rely on SCOUTb2 output as proof of compliance or non-compliance.

8.5 No Professional Advice

SCOUTb2 is an automated scanning tool. It is not a substitute for:

• Professional accessibility auditing by qualified experts
• Manual testing with assistive technologies (screen readers, switch devices, etc.)
• Usability testing with people with disabilities
• Legal counsel regarding accessibility laws, ADA requirements, or regulatory compliance
• Professional SEO, security, or performance consulting

We strongly recommend that you supplement any automated testing with professional human review and legal guidance appropriate to your jurisdiction and industry.

8.6 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL bee2.io LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, BUSINESS OPPORTUNITIES, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH: (A) YOUR USE OF OR INABILITY TO USE THE SERVICE; (B) ANY INACCURACY, ERROR, OR OMISSION IN SCAN RESULTS, REPORTS, OR RECOMMENDATIONS; (C) ANY RELIANCE ON AUDIT RESULTS OR AI-GENERATED CONTENT; (D) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA; (E) ANY THIRD-PARTY CLAIMS RELATED TO YOUR WEBSITE'S ACCESSIBILITY OR COMPLIANCE; OR (F) ANY OTHER MATTER RELATING TO THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO bee2.io LLC IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IF YOU HAVE NOT PAID ANY AMOUNTS, OUR TOTAL LIABILITY SHALL NOT EXCEED TEN U.S. DOLLARS ($10.00).

THE FOREGOING LIMITATIONS APPLY REGARDLESS OF THE LEGAL THEORY UPON WHICH THE CLAIM IS BASED, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, AND EVEN IF bee2.io LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH CASES, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

9. Indemnification

You agree to indemnify, defend, and hold harmless bee2.io LLC, its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, demands, actions, liabilities, losses, damages, judgments, settlements, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:

• Your violation of these Terms
• Your use of or reliance on the Service, including any reliance on scan results, scores, reports, or AI-generated recommendations
• Unauthorized scanning of third-party websites
• Any claim that your website fails to meet accessibility standards, regulations, or legal requirements, regardless of whether SCOUTb2 was used to audit the website
• Your negligence or willful misconduct
• Any third-party claim arising from your use of the Service or the content of your website

This indemnification obligation will survive the termination of these Terms and your use of the Service.

10. Termination

We may suspend or terminate your account if you:

• Violate these Terms
• Fail to pay subscription fees
• Engage in abusive or fraudulent behavior
• Request account deletion

Upon termination, you lose access to PRO features immediately. If you delete your account, all associated data is purged immediately. Server-side scan results are automatically deleted after 90 days. Local scan data (chrome.storage.local) remains on your device until you uninstall the extension or clear storage manually.

The following sections survive termination of these Terms: Section 8 (Disclaimers and Limitations), Section 9 (Indemnification), Section 12 (Governing Law and Jurisdiction), Section 13 (Dispute Resolution), Section 15 (Severability), and Section 16 (Entire Agreement).

11. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

Website Analytics

We use Google Analytics to measure website usage on scoutb2.io. Analytics cookies are only activated with your explicit consent via the cookie banner. If you select "Essential Only," no analytics data is collected. See our Privacy Policy for details on what data is collected and how to withdraw consent.

12. Governing Law and Jurisdiction

These Terms and any disputes arising out of or relating to them or the Service shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict of law principles.

You agree that any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in the Commonwealth of Massachusetts. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.

13. Dispute Resolution

Before initiating any formal legal proceeding, you agree to first contact us at [email protected] and attempt to resolve the dispute informally for at least thirty (30) days. If the dispute is not resolved informally, either party may proceed with formal legal action in accordance with Section 12.

TO THE EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY CLAIMS SHALL BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

14. Modification of Terms

We reserve the right to modify, amend, or replace these Terms at any time at our sole discretion. Material changes will be communicated via email to the address associated with your account and/or via a prominent notice in the extension or on our website at least fifteen (15) days before the changes take effect.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must discontinue use of the Service and cancel any active subscription.

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions of these Terms shall remain in full force and effect. The invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and bee2.io LLC regarding the Service and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning the subject matter hereof. No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
